Copyright Policy & Takedown Procedure

COPYRIGHT INFRINGEMENT NOTICES. We respect intellectual property rights and respond promptly to valid copyright complaints. If you believe Content on www.thewisemarketing.cominfringes your copyright, follow the procedure in Section 4 and submit the Notice in Annexure A. Knowingly false or abusive notices may attract liability under Section 52A of the Copyright Act, 1957 and Section 512(f) of the United States Digital Millennium Copyright Act.

1. Our Position

Wisework Media Private Limited (“the Company”, “we”, “us”, “our”) operates www.thewisemarketing.com (the “Website”) and respects the intellectual property rights of others. We comply with the Copyright Act, 1957 of India, the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and — to the extent applicable to the Website’s global operations — the United States Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”) and the EU Digital Services Act (Regulation (EU) 2022/2065).

This Policy explains how copyright owners and their authorised agents can request removal of infringing Content from the Website, and how Users whose Content has been removed can submit a counter-notice.

2. Designated Copyright Agent

In accordance with Rule 75 of the Copyright Rules, 2013 and 17 U.S.C. § 512(c)(2), the following officer is designated to receive copyright complaints:

Notices submitted to addresses other than those listed above may not receive a timely response.

3. Who May Submit a Notice

A copyright takedown notice may be submitted by:

• the owner of an exclusive right under copyright in the work allegedly infringed; or
• a person duly authorised in writing to act on behalf of such owner.

4. Notice Requirements

To enable us to act, your notice must contain:

• Identification of the copyrighted work claimed to have been infringed (title, author, year, registration number if any, sample link or attachment).
• Identification of the allegedly infringing Content on the Website, with the exact URL(s) and a description sufficient to enable us to locate it.
• Your full legal name, postal address, telephone number, and email address.
• If submitting on behalf of another, evidence of your authority to act.
• A statement, made under oath or affirmation, that the information in the notice is accurate.
• A statement that you have a good-faith belief that the use of the Content in the manner complained of is not authorised by the copyright owner, its agent, or the law.
• A statement that you understand that knowingly making a materially false statement may attract liability under Section 52A of the Copyright Act, 1957 and, where applicable, 17 U.S.C. § 512(f) of the DMCA.
• Your physical or electronic signature.

A template Notice is provided in Annexure A. Incomplete notices will be returned for amendment and may delay action.

5. Action We Will Take

On receipt of a complete and valid notice we will, in accordance with Rule 75 of the Copyright Rules, 2013, Rule 3(1)(d) of the IT Rules, 2021, and 17 U.S.C. § 512(c) of the DMCA:

• acknowledge receipt within 24 hours;
• disable access to or remove the allegedly infringing Content within 36 hours of receipt of a complete notice in respect of the Indian operations of the Website;
• inform the User who posted the Content (the “Affected User”), provide a copy of the notice, and inform the Affected User of the right to submit a counter-notice;
• retain the disabled Content in escrow for 14 days from the date of disabling, in accordance with Rule 75(3) of the Copyright Rules, 2013;
• if the rights holder does not produce, within those 14 days, an order from a court of competent jurisdiction restraining the Affected User from making the Content available, restore the Content if a valid counter-notice has been received;
• retain a record of the notice, action taken, and any counter-notice in our internal Takedown Log.

6. Counter-Notice

If your Content has been removed and you have a good-faith belief that the removal is mistaken or that you have the right to use the Content, you may submit a counter-notice to legal@wiseworkmedia.com.

Your counter-notice must contain:

• Identification of the Content that has been removed and the URL at which it appeared before removal.
• Your full legal name, postal address, telephone number, and email address.
• A statement that you have a good-faith belief that the Content was removed as a result of mistake or misidentification.
• Your consent to the jurisdiction of the courts at Gautam Buddha Nagar, Uttar Pradesh, India and (if you are outside India) of any other jurisdiction in which you may be sued by the rights holder.
• A statement that you understand that knowingly making a materially false statement may attract liability under Section 52A of the Copyright Act, 1957 and, where applicable, 17 U.S.C. § 512(f) of the DMCA.
• Your physical or electronic signature.

A template Counter-Notice is provided in Annexure B. On receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not produce a court order restraining further publication within the period specified in Section 5, we will restore the Content.

7. Repeat Infringers

In appropriate circumstances, we will suspend or terminate the Accounts of Users whom we determine, in our sole discretion, to be repeat infringers, and may report such conduct to law enforcement and to the affected rights holders.

8. Other Intellectual Property

Complaints regarding trade marks, designs, patents, passing off, or other intellectual property may be submitted to legal@wiseworkmedia.com using the format and good-faith standards in Sections 4 to 6, with appropriate adaptations. We will respond in accordance with the Grievance Redressal Policy.

9. False or Abusive Notices

Knowingly making a materially false statement in a notice or counter-notice may attract criminal and civil liability under Section 52A of the Copyright Act, 1957 and, where applicable, 17 U.S.C. § 512(f) of the DMCA. We reserve the right to recover all costs, damages, and reasonable legal fees from any person who submits a false or abusive notice. Repeat false notices may also result in restrictions on future engagement with the Website.

10. Updates to this Policy

We may update this Policy from time to time to reflect legal or operational changes. We will indicate the date of each revision when this Policy comes into force.

Annexure A — Copyright Infringement Notice

I, the undersigned, give notice under Section 52(1)(c) of the Copyright Act, 1957 read with Rule 75 of the Copyright Rules, 2013 and, where applicable, 17 U.S.C. § 512(c) of the United States Digital Millennium Copyright Act, that Content available on www.thewisemarketing.com infringes a copyright in respect of which I am the rights holder or duly authorised agent. Please provide the following:

Part 1 — Complainant

• Full legal name
• Capacity (rights holder / authorised agent) — if agent, attach written authorisation
• Postal address
• Email address
• Telephone number

Part 2 — Copyrighted Work

• Title and description of the copyrighted work
• Author / creator
• Year of first publication
• Copyright registration number (if any)

• the information in this Notice is true and accurate to the best of your knowledge;
• you have a good-faith belief that the use of the Content in the manner complained of is not authorised by the copyright owner, its agent, or the law;
• you are the rights holder or are duly authorised in writing to act on the rights holder’s behalf;
• you understand that knowingly making a materially false statement in this Notice may attract liability under Section 52A of the Copyright Act, 1957 and, where applicable, 17 U.S.C. § 512(f) of the DMCA, and may result in liability for damages and legal costs.

Annexure B — Copyright Counter-Notice

• you have a good-faith belief that the Content was removed or disabled as a result of mistake or misidentification;
• you consent to the jurisdiction of the courts at Gautam Buddha Nagar, Uttar Pradesh, India, and, if you are located outside India, of any other jurisdiction in which you may be sued by the original complainant;
• you will accept service of process from the original complainant or its authorised agent;
• you understand that knowingly making a materially false statement in this Counter-Notice may attract liability under Section 52A of the Copyright Act, 1957 and, where applicable, 17 U.S.C. § 512(f) of the DMCA, and may result in liability for damages and legal costs.
