INCORPORATED INTO THE TERMS OF SERVICE. This Acceptable Use Policy (“AUP”) is incorporated by reference into the Terms of Service of www.thewisemarketing.com. By accessing or using the Website you agree to comply with this AUP. Breach of this AUP is a material breach of the Terms of Service and may result in removal of Content, suspension or termination of your Account, retention of payments to the extent of damages, and referral to law enforcement.
1. Scope
This AUP applies to:
- all Users of the Website, including visitors, registered Account holders, advertisers, and Publishers using the PR Self-Publish marketplace;
- all Content uploaded, transmitted, posted, or otherwise made available on or through the Website by Users;
- all use of automated systems, APIs, and integrations interacting with the Website.
Capitalised terms not defined here have the meanings given in the Terms of Service.
2. Statutorily Prohibited Content (Rule 3(1)(b), IT Rules 2021)
In compliance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, modify, publish, transmit, store, update, or share any information that:
- belongs to another person and to which the User does not have any right;
- is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
- is harmful to children;
- infringes any patent, trademark, copyright, or other proprietary rights;
- violates any law for the time being in force;
- deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to other nations;
- contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
- is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person;
- violates any applicable law, including but not limited to the Information Technology Act, 2000 and rules made thereunder.
3. Additional Prohibited Conduct
In addition to Section 2, you must not:
- upload Content that promotes, sells, or facilitates illegal goods or services, including narcotic drugs, controlled substances, weapons, counterfeit goods, fake reviews, hacking or surveillance services, or services requiring a licence under Indian law without holding such licence;
- upload Content that violates the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 or makes unsubstantiated claims about cure, prevention, or treatment of disease;
- upload Content relating to securities, investments, or insurance unless you hold the requisite SEBI, RBI, or IRDAI registration and clearly identify it;
- upload Content relating to alcohol, tobacco, gambling, betting, online real-money gaming, lottery, or adult products, except where lawful in the destination jurisdiction and clearly age-gated and labelled;
- upload political advertising, religious propaganda, or content intended to influence elections, except in compliance with the Representation of the People Act, 1951 and the Election Commission of India’s Model Code of Conduct;
- submit Content that contains personal data of third parties without their informed consent;
- submit Paid Placements without the “Sponsored” or “Paid Partnership” disclosure required by the ASCI Guidelines for Influencer Advertising in Digital Media, 2021;
- engage in stuffing, cloaking, hidden text, link schemes, or other techniques designed to manipulate search engine rankings in violation of Google Search Essentials or other applicable search engine policies;
- post fake reviews, manipulated testimonials, or undisclosed paid endorsements;
- attempt to circumvent or compromise the security, access controls, rate limits, or content moderation systems of the Website;
- use the Website to send unsolicited bulk email, spam, phishing, or malware;
- scrape, mirror, frame, or systematically copy Content from the Website without our prior written consent;
- use Content from the Website to train, fine-tune, or evaluate any artificial intelligence model, except as expressly permitted by our llms.txt file or by separate written agreement;
- interfere with the use of the Website by any other User, including by harassment, doxxing, threats, or coordinated abuse;
- misrepresent your identity, affiliation, qualifications, or authority;
- violate the terms of any third-party platform, API, or service used in connection with the Website.
4. Content Standards for Editorial and Sponsored Articles
In addition to legal compliance, all Content submitted for publication must meet the following minimum standards:
- Accurate. Statements of fact must be verifiable and supported by identified sources where required.
- Original or licensed. Content must be original, in the public domain, or used under a valid licence with attribution.
- Clearly attributed. Authors, sources, quotations, statistics, and images must be attributed.
- Free of personal attacks. Comparative statements about identifiable persons or competitors must be substantiated and within fair comment.
- Disclosed conflicts. Material commercial relationships, sponsorships, and conflicts of interest must be disclosed.
- Compliant images. Images must be original, royalty-free, or duly licensed; AI-generated images must be labelled where required by Applicable Law.
5. Use of Artificial Intelligence by Users
You may use AI tools to draft or assist your User Content, but you remain solely responsible for the final Content. You must:
- verify the factual accuracy of AI-generated text before submission;
- disclose AI generation of images or audio where required by Applicable Law or the ASCI Code;
- not submit Content that constitutes a deepfake or synthetic impersonation of a real, identifiable person without that person’s informed written consent;
- not use artificial intelligence tools to create, generate, upload, or distribute any content that constitutes Child Sexual Abuse Material (CSAM) or Non-Consensual Intimate Imagery (NCII), including ‘deepfakes’ or any synthetic media that depicts a real or fictional person in a sexually explicit or suggestive manner without their express legal consent;
- not submit Content infringing the intellectual property of third parties through the use of AI.
6. Reporting Violations
If you become aware of Content or conduct on the Website that breaches this AUP or Applicable Law, please report it through our Grievance Redressal Policy or by writing to legal@wiseworkmedia.com. We will act in accordance with the timelines set out in that Policy.
7. Enforcement
7.1 We may, at our sole discretion and without prior notice, take any of the following actions in response to a breach or suspected breach of this AUP:
- issue a warning;
- edit Content for compliance;
- apply a disclaimer or label to Content;
- temporarily or permanently remove Content;
- suspend or terminate your Account;
- retain payments to the extent of damages, recovery costs, or third-party indemnification incurred;
- preserve and disclose information to law enforcement or other competent authorities, on receipt of a valid legal request;
- pursue civil and criminal remedies.
7.2 In accordance with Rule 3(2)(b) of the IT Rules, 2021, complaints relating to non-consensual intimate imagery, impersonation, or morphed images of a sexual nature will be acted upon within 24 hours of receipt of a valid complaint.
7.3 In accordance with Rule 3(1)(d) of the IT Rules, 2021, we will, on receipt of actual knowledge in the form of a court order or notification by the Appropriate Government or its agency, remove or disable access to information prohibited under Applicable Law within 36 hours.
8. Right of Appeal
If your Content is removed or your Account is suspended, you may appeal in accordance with the Grievance Redressal Policy. Where applicable, you also retain the right to approach the Grievance Appellate Committee constituted under Rule 3A of the IT Rules, 2021.
9. Updates to this AUP
We may update this AUP at any time to address new risks, regulatory changes, or operational requirements. We will indicate the date of each revision when this AUP comes into force. Continued use of the Website after any update constitutes acceptance of the updated AUP.
